(hereinafter referred to as the “Provider”)
1. Introductory Provisions
These General Terms and Conditions (“GTC”) govern the contractual relationship between the Provider and the Customer in the arrangement of services including private boat rentals and cruises on the Vltava River in Prague, catering services, and related additional services (music, decorations, entertainment, etc.) (hereinafter referred to as “Services”).
The services may be ordered via the website, by email, by phone, or through other communication channels.
The Provider acts as an intermediary arranging services provided by third‑party operators such as boat owners, captains, catering suppliers, and other service providers.
Operational responsibility for the cruise, including the vessel, crew, navigation, and safety procedures, lies with the respective boat operator.
2. Booking and Conclusion of Contract
2.1 The contract between the Provider and the Customer is concluded once the Provider confirms the booking in writing (email or booking system confirmation).
2.2 The Customer is responsible for providing accurate and complete information during the booking process.
2.3 The minimum number of persons, available routes, vessel capacities, and service availability are governed by the current offer provided to the Customer or published on the website.
3. Price and Payment Terms
3.1 Prices may be stated and paid in different currencies including CZK, EUR, USD, or GBP depending on the agreement with the Customer.
3.2 The final price and currency will always be specified in the booking confirmation.
3.3 Standard payment terms:
- 50% deposit within 5 business days after booking confirmation
- remaining 50% no later than 14 days before the scheduled cruise, unless otherwise agreed with the Provider and the Customer.
3.4 The Customer may pay the remaining balance earlier if desired.
3.5 Payment methods may include bank transfer, online payment (if available), or other agreed payment methods.
3.6 If the remaining balance is not paid no later than 14 days before the scheduled cruise, the Provider reserves the right to cancel the booking. In such case, the deposit already paid may be retained as a cancellation fee, unless otherwise agreed with the Provider and the Customer.
3.7 All payments made by the Customer are considered confirmation of the booking and acceptance of these General Terms and Conditions.
4. Cancellation Policy / Withdrawal from the Contract
Cancellation fees are calculated only from the amount already paid by the Customer at the time of cancellation. The Customer is not required to pay any cancellation fee exceeding the amount already paid.
If the Customer cancels the cruise, the cancellation must be submitted in writing (email) to info@rivercruiseprague.com.
4.1 More than 30 calendar days before the cruise: 0% cancellation fee (full refund)
4.2 15–30 calendar days before the cruise: 30% cancellation fee
4.3 7–14 calendar days before the cruise: 50% cancellation fee
4.4 Less than 7 calendar days before the cruise: 100% cancellation fee (no refund)
4.5 If the cruise is cancelled by the Provider or the boat operator due to technical issues with the vessel, extreme weather conditions affecting safe navigation, river traffic restrictions, or other force majeure events beyond reasonable control (such as floods, river closures, or government restrictions), the Customer is entitled either to a full refund of the amount paid or to reschedule the cruise for an alternative available date. No additional compensation shall be provided.
4.6 Rain or normal weather conditions are not considered valid reasons for cancellation unless navigation safety is affected and the decision is made by the captain.
5. Cruise Conduct, Safety, and On‑board Rules
5.1 All participants must follow the instructions of the captain and crew.
5.2 Bringing and consuming personal alcohol on board is permitted only with prior agreement with the Provider and may be subject to a corkage fee.
5.3 Smoking inside the vessel, dangerous behavior, or illegal substances are strictly prohibited. Violation of these rules may result in immediate termination of the cruise without refund.
5.4 The Customer is responsible for the behavior of all participants during the cruise.
5.5 Any damage caused to the vessel, equipment, crew, or third‑party property must be compensated by the Customer.
5.6 If the Customer or participants arrive late at the departure point, the cruise duration may be shortened accordingly without entitlement to a refund.
5.7 The final number of participants must be confirmed no later than 48 hours before the cruise. Catering and other services may be prepared based on this confirmed number.
5.8 The planned route of the cruise may change due to river traffic, locks, navigation restrictions, or instructions from navigation authorities.
5.9 The captain reserves the right to refuse boarding to intoxicated or aggressive passengers if their behavior may endanger the safety of the cruise.
5.10 The number of passengers must not exceed the confirmed number of participants or the maximum permitted capacity of the vessel. The captain or boat operator reserves the right to refuse boarding to additional passengers exceeding the confirmed number or the legally permitted capacity of the vessel. No refund or compensation shall be provided in such cases.
6. Complaints
6.1 Any complaints regarding the arranged services must be submitted in writing within 14 days after the cruise to info@rivercruiseprague.com.
6.2 As the Provider acts solely as an intermediary, the complaint may be forwarded to the relevant third-party service provider (such as the boat operator or catering supplier) for further assessment and resolution.
7. Personal Data Protection
7.1 Personal data provided by the Customer are processed solely for the purpose of booking and providing the requested services.
7.2 Detailed information about personal data processing is available in the Privacy Policy published on the website.
8. Limitation of Liability
8.1 The Provider acts solely as an intermediary arranging services provided by third‑party suppliers.
8.2 The Provider is not liable for:
- the quality or execution of services provided by third‑party operators
- delays caused by navigation conditions, river traffic, locks, or weather
- changes to the cruise route required by navigation authorities
- dissatisfaction with catering, music, decoration, or other optional services provided by third parties
8.3 To the maximum extent permitted by applicable law, the Provider’s liability is limited to the amount paid by the Customer for the arranged service.
9. Final Provisions
These Terms and Conditions are governed by the laws of the Czech Republic.
Any disputes shall be resolved by the competent courts of the Czech Republic.
These General Terms and Conditions take effect on March 1, 2025.
